This week we will take a look at another path our government lead us down on the way to destruction in the ‘shoal waters’ of a secular world. The clear principal to note the righteousness of a land is directly affected by its judges. Our Founding Fathers understood the potential power of judges and the lasting consequences that could occur through an improper use of judicial power. Of the twenty-seven grievances in the Declaration of Independence listing why America separated from Great Britain, four addressed the abuse of British judicial power. Knowing the potential power of judges to do damage, with prudent foresight the Founding Fathers placed numerous restraints upon the judiciary within the Constitution, resulting in four judicial principles meant to guide and protect us from their abuse of power. Unfortunately, with most citizens being completely unaware of these Constitutional restraints, it would seem those ‘protective moorings’ have been cast off, allowing the American judiciary to drift well off course from the original design, thus placing the nation ‘square’ in the center of damaging ‘shoal waters’…clearly demonstrating the truth of Isaiah 1:25 that the righteousness of a land is directly affected by its judges. It has been judges and not legislatures who have imposed on America the great majority of its unrighteousness policies. For example, abortion on demand, prohibition on prayer before school athletic events and graduations, exclusion of the Ten Commandments from public buildings, exclusion of religious acknowledgements in classrooms, etc. Today we will look at same-sex marriage , an action initiated by judicial decisions demanding that state legislatures set aside four centuries of American law defining marriage as the union of a man and a woman. Charles Evans Hughes, the Chief Justice of the U.S. Supreme Court from 1930 to 1941, said, “We are under a Constitution…but, the Constitution is what the judges say it is.” [Charles Evans Hughes, The Autobiographical Note of Charles Evans Hughes, ed. Further, Chief Justice Earl Warren, who served from 1953 to 1969, stated the Constitution “must draw its meaning from the evolving standards of decency that mark the progress (?) of a maturing society [Trop v. Dulles, 356 U.S. 86, 101, 1958]. Any wonder the nation is dangerously ‘floundering in shoal waters’?
Nearly three dozen foreign countries currently grant rights to homosexual individuals and statistics from those countries provide clear warnings to America [Timothy Dailey, “Comparing the Lifestyles of Homosexual Couples to Married Couples”, Family Research Council]. Only a small percentage of individuals are homosexual. Just as less than 4% of Americans are homosexual [Frank Newport, “LGBT Americans Continue to Skew Democratic and Liberal”, Gallup Politics, July 30, 2014], Wikipedia…which is very positive toward homosexuality…reports the same general low incidence in other countries that keep such statistics. The statistics from those nations also show that only a very small percentage from within that small group marry even when given the opportunity [Wikipedia, “Demographics of Sexual Orientation”]. According to statistics from Iceland, while there are some 315,000 citizens in that nation, in 2011 only 36 homosexuals in the entire nation married, and 10 homosexuals divorced [Statistics Iceland, “Marriages and Divorces”]. These low numbers are not unusual.
While a high percentage of traditional married couples remain married for up to 20 years or longer…the vast majority of homosexual relationships are short-lived and transitory. For example, in the Netherlands, a long-time gay tolerant marriage nation, the average duration of a homosexual relationship is one and a half years [Timothy Dailey, “The Slippery Slope of Same-Sex Marriage”, Family Research Council, 2004]. Lesbians seemed particularly inclined toward a lack of commitment. While only 44% of homosexual marriages included lesbians, they were involved in 66% of homosexual divorces [Ibid]. Lesbians experience a rate of domestic violence forty-four times greater than that of traditionally married women [Ibid].
While three-quarters or more of traditional married couples remain faithful to each other, homosexual couples typically engage in a shocking degree of promiscuity. A Dutch study found that “committed” homosexual couples have an average of eight sexual partners outside of the relationship per year [Stanley Kurtz, “The End of Marriage in Scandinavia”, Weekly Standard, 9, issue 20, February 2, 2004]. This is standard in most countries that accept homosexual relationships and marriage. The conclusion we might come to is that marriage itself is generally meaningless. The Office for National Statistics for the UK in 2011, reported that marriage is slowly dying in Scandinavia. A majority of children in Sweden and Norway are born out of wedlock. Sixty percent of first-born children in Denmark have unmarried parents. Not coincidentally, these countries have had something close to full gay marriage for a decade or more. Since Great Britain adopted homosexual marriage, the marriage rate has now hit its lowest levels since measurements began in 1862 [Mike Opelka, “Lesbian Activist’s Surprisingly Candid Speech: Gay Marriage Fight Is a ‘Lie’ to Destroy Marriage”, The Blaze, April 29, 2013]. Some homosexual activists openly acknowledge that their ultimate goal is the elimination of all marriage and that homosexual marriage is merely the first step toward that objective.
Thus, the 5,500-year-old definition of marriage has been rewritten, and cultures have been completely upended and restructured merely to accommodate the wishes of a small percentage of the population. These ‘wishes’ are nothing more than ‘inclinations’ deliberately used to indicate personal choice. Science continues to affirm that there is no homosexual gene [Brad Harrub, Bert Thompson, & Dave Miller, “This the Way God Made Me; A Scientific Examination of Homosexuality and the ‘Gay’ Gene”, The True Origin Archive, 2003; plus more]. The oft heard claim of “I can’t help being homosexual, just as a person can’t help being black, female, or tall” is fallacious and not backed by scientific evidence.
All of this has come about in our nation with the help and blessings of our judges…our government. Just a few short years after the judiciary attack on the morals of this country, civil courts not only protect homosexuality but openly enforce punitive penalties against those who refuse to affirm and celebrate it [Mike Morris, “Council Passes Equal Rights Ordinance”, Houston Chronicle, May 28, 2014; plus more]. For example, San Antonio, Texas, has a policy which places a $500 per day fine and a permanent exclusion from ever running for public office on any citizen who criticizes homosexuality and homosexual marriage. Such rapid change is possible only when there is no firm foundation of Biblical convictions, especially among the eight out of ten Americans who profess Christianity [Job 31:15; Psalm 22:9-10; 139:13-16; Isaiah 44:2; Jeremiah 1:4-5; 49:5; Luke 1:15]. We even have some churches that speak out against pastors who will exercise the fortitude to speak out against such government actions. This is what happens when churches divorce themselves from politics. When the charts… God’s Will… are set aside, the “ship of state” eventually finds itself unable to maneuver out of the secular “shoal waters”.
